TERMS OF SERVICE
1. SCOPE
These Terms of Service apply to the use of the mobile application "Bet Against Yourself" (hereinafter "App"), operated by August Albrecht, Bleibtreustrasse 41, 10623 Berlin, Germany, support@getbetagainstyourself.com.
2. SERVICE DESCRIPTION
Bet Against Yourself is an alarm app that uses the principle of loss aversion. Users set a wake-up time and commit a monetary stake. If the step goal chosen for the alarm (50 to 200 steps) is not recorded within 5 minutes after the alarm, the stake is automatically charged. The App is a self-commitment tool, not gambling: there is nothing to win, and completing the challenge only means that no fee is charged.
3. MINIMUM AGE
Use of the App is only permitted for users aged 18 and older. By registering, you confirm that you are at least 18 years old.
4. REGISTRATION AND ACCOUNT
You are required to provide accurate information during registration. You are responsible for all activities that occur under your account. Sharing access credentials with third parties is prohibited.
5. PAYMENTS
Payments are processed through the third-party provider Stripe, Inc., by card or Apple Pay. We do not store credit card data on our servers. A charge only occurs if the challenge is not completed (step goal not reached within 5 minutes after the alarm). The stake is €5 to €100 per bet. Forfeited stakes are retained by the operator of the App as a fee; they are not donated or passed on to third parties.
The result is determined on our servers. If the App does not report a completed challenge within 35 minutes after the alarm – for example because the App was closed, the device was offline or switched off – the challenge counts as not completed and the stake is charged, even if the App is not open. If a charge fails, no new bets can be placed until it has been settled with a valid card or Apple Pay. Refunds are generally excluded unless a technical error on our part occurs.
6. CANCELLATION
A bet can be cancelled free of charge up to 2 hours before the set wake-up time. After this deadline, cancellation is no longer possible.
7. HEALTHKIT AND HEALTH DATA
The App counts steps using the motion sensors of your device (Core Motion). Step data is processed on your device; only the step count of a challenge is transmitted to our servers to determine the result.
8. AVAILABILITY
We strive for high availability of the App but do not guarantee uninterrupted operation. In the event of technical failures that prevent accurate step measurement, no charges will be made.
9. LIMITATION OF LIABILITY
The App is intended solely for personal motivation. We are not liable for indirect damages, lost profits, or consequential damages. Our liability is limited to the amount of the most recent transaction.
10. CHANGES
We reserve the right to update these Terms of Service at any time. Material changes will be communicated via push notification or email. Continued use of the App after changes take effect constitutes acceptance.
11. GOVERNING LAW
The laws of the Federal Republic of Germany apply. Place of jurisdiction is Berlin.
